How Fundamental Tutoring Co collects, uses, and protects personal information — including information about students.
Fundamental Tutoring Co ("FTC", "we", "us", "our") is a tutoring, essay editing, and education resources business operating on Sydney's Northern Beaches and online, ABN 99 327 909 664.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what we collect, why, how we protect it, and your rights. Contact: contact@fundamentaltutoring.com.au.
The information we collect depends on how you deal with us. It may include:
We collect information directly from you — through our website enquiry form, email, phone, or during sessions. We do not buy personal information from third parties.
Because we tutor school-aged students, much of the personal information we hold relates to minors. We collect this information from a parent or guardian, or from the student with their parent or guardian's knowledge, and use it solely to deliver tutoring and editing services. We never use a student's information for marketing directed at the student, and tutors are only given the information they need to teach that student effectively.
We use personal information to:
Marketing. With your consent (or where you'd reasonably expect it, such as being an existing client), we may occasionally send you updates about our services — for example, term availability or the launch of our resources platform. Every marketing email includes an unsubscribe link, and you can opt out at any time by contacting us. We comply with the Spam Act 2003 (Cth).
We share personal information only as needed to run the business:
We do not sell, rent, or trade personal information to anyone.
Some of our service providers (such as Google and our website host) store data on servers located outside Australia, including in the United States. Where this occurs, the data is held by major providers with industry-standard security practices. By providing your information, you acknowledge it may be stored with these providers.
We take reasonable steps to protect personal information from misuse, loss, and unauthorised access, including two-factor authentication on business accounts, access limited to FTC's founders and administrative team on a need-to-know basis, tutor access limited to their own students, and secure cloud storage. We retain personal information only as long as needed for the purposes above or as required by law (for example, financial records must be kept for statutory periods), after which it is deleted or de-identified.
If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme.
You may request access to, or correction of, the personal information we hold about you or your child at any time by emailing contact@fundamentaltutoring.com.au. We will respond within a reasonable time and there is no charge for making a request. In limited circumstances the law permits us to refuse access; if so, we will explain why.
Our website does not currently set cookies. If we introduce analytics or advertising tools that use cookies in the future, we will update this policy first. Disabling cookies in your browser will not affect your ability to enquire with us.

The terms that apply to all tutoring, editing, and resources services provided by Fundamental Tutoring Co — including how bookings, payments, and cancellations work.
These terms apply to all tutoring, editing, and (when available) resources platform services provided by Fundamental Tutoring Co ("FTC", "we", "us"), ABN 99 327 909 664. By booking or using our services, you agree to these terms. "You" means the parent or guardian arranging services for a student, or an adult student engaging us directly. You must be at least 18 to enter into these terms and be responsible for payment.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
We do not use lock-in contracts. Here is how engagement works:
We may decline or discontinue an engagement where we cannot provide a suitable tutor, and will tell you promptly if so.
Fees are payable as agreed at the time of booking, by direct bank transfer to FTC's nominated account. Invoices or receipts are issued for each billing period. Fees are in Australian dollars. If we change our rates, we will give you at least 14 days' written notice, and no change will apply to sessions or packages already paid for.
Our editing service provides feedback, corrections, and suggestions on work written by the student. We do not write assignments, essays, or exam responses for students, in whole or in part, and we will decline requests to do so. By submitting work for editing, you confirm the work is the student's own and that our feedback will be used as guidance for the student's own revisions. Students remain responsible for complying with their school's or university's academic integrity policies.
Cancelling a session (you). Please give at least 24 hours' notice to your tutor or our admin team to cancel or reschedule. With 24 hours' notice or more, the session is rescheduled or credited at no charge. With less than 24 hours' notice, or a no-show, the session fee is payable, because your tutor's time was reserved and can no longer be offered to another student. We apply this reasonably — genuine illness and emergencies are treated with common sense, and we may waive the fee at our discretion.
Cancelling a session (us). If your tutor cannot attend, we will tell you as early as possible and offer a make-up session or a credit. You are never charged for a session we cancel.
Stopping altogether. Because there is no lock-in, you can discontinue ongoing weekly tutoring at any time by telling us in writing. You pay only for sessions already delivered and any late-cancellation fees incurred.
Packages. If you have pre-paid a package and choose to discontinue, we will refund the unused balance, calculated as the amount paid less the value of sessions already delivered at the standard (non-package) hourly rate, and less any late-cancellation fees. Refunds are processed within 14 days of your written request.
Editing. Editing fees are charged per submission. If you withdraw a submission before an editor has begun work, you receive a full refund. Once work has begun, the fee is payable.
Your consumer rights. In addition to the above, you are entitled to remedies under the Australian Consumer Law if our services fail to meet a consumer guarantee — for example, if a service is not delivered with due care and skill. Nothing in this clause limits those rights.
All FTC tutors hold a current NSW Working With Children Check — this is a strict condition of working with us. In-home sessions must take place in a shared, open area of the home (not a bedroom) with a parent or guardian present on the premises. Online sessions run on mainstream supervised platforms, and parents are welcome to observe. Any concern about tutor conduct should be raised with us immediately at contact@fundamentaltutoring.com.au — we treat every report seriously.
We ask that students come to sessions ready to work, and that tutors are treated with courtesy and respect. We may end an engagement where a student or family member behaves abusively toward a tutor, or where fees remain unpaid after reasonable follow-up. Any amounts owing for delivered sessions remain payable.
Teaching materials, resources, and templates we provide remain FTC's property and are for the enrolled student's personal study use only. They may not be shared, republished, or resold. Work written by the student remains the student's own.
We take real care in selecting tutors and delivering our services, but academic outcomes depend on many factors, and we do not guarantee specific grades, marks, or ATAR results. To the extent permitted by law, our liability for any claim arising from our services is limited to resupplying the relevant services or refunding the amount you paid for them in the relevant billing period. This clause does not limit your rights under the Australian Consumer Law.
Our collection and handling of personal information — including information about students — is governed by our Privacy Policy, which forms part of these terms.
We may update these terms from time to time. Changes apply to bookings made after the updated terms are published, and we will not change the terms of a package you have already paid for without your agreement.
These terms are governed by the laws of New South Wales, Australia.
